Legal Question in Family Law in Utah

Alienation of Affection

I am dating a man who is separated from his wife and she is threatening to sue me for Alienation of Affection. What can I use as defense? How successful might she be? She says she is suing for $300,000. Is that really reasonable?

Re: Alienation of Affection

Much of it depends on when you started dating him. If you started dating before he separated and you are perceived to be the cause of the breakup of the marriage, then she may have a claim against you. However, if he was already separated when you met him, then there shouldn't be anything to worry about.
