Re: alienation of affections

Alienation of affection is a tort - a violation of personal rights. The perpetrator can be held liable for actual damages, as well as punitive damages. You will have to prove that the Defendant knew or should have known that your husband (?) was a married man, and that she acted to entice his attention with disregard for your marriage. You should probably file in district court, and have the option of requesting a jury. However, with all due respect, your husband may also have significant responsibility and should also be held accountable for his actions.
