Legal Question in Family Law in Utah

Annulment or Divorce

I have been married for 7 months. My husband was not forthright about all of his premarital debt. We have no assets together. Do I need to file for an annulment or divorce in order to protect my assets and not be obligated for his debt?

Re: Annulment or Divorce

Whether you file for annulment or divorce, you won't be obligated to pay any of his premarital debt. As long as you keep your assets in your name only, they should be protected in the event any of his creditors sue him to collect any amounts owing. Depending on how you wish to proceed, his failure to disclose his financial situation would probably constitute grounds for annulment. Otherwise, you would get a divorce.
