Legal Question in Family Law in Utah
I need an attorney that will help me get child support reduced. I agreed to pay at a sole custody rate because of cost of legal fees, duration of divorce action (over 2 years), and to settle other financial matters. Bottom line, my finances were being held hostage as my X dragged out the divorce action.
The arguments I have to reduce child support to an amount based upon number of overnights and incomes;
- She extorted me financially for additional parent-time
- I was being held hostage financially during divorce action, couldn't purchase home
- My youngest stays with me over 140 nights/year
- I drive the kids around more than was agreed upon; school, band lessons, soccer practice
- I'm struggling financially because I purchased a home nice enough for my kids to want to visit
Questions; Do I have a strong enough case to get child support calculated based off income and overnights? If not, what can I do to build a case to get child support reduced. If so, let's get it done!

Did you have an attorney? What you agreed to may be hard to change at this point. You may find that it will cost more to change than what it would be after the change. Did you go to utcourts.gov to see what the change in child support would be? http://www.utcourts.gov/childsupport/calculator
Just because you do more than what is anticipated does not mean it is a material change of circumstances to warrant a change. It may just mean you are a good father and not a dead beat dad.
