Change in circumstances

My original Divorce Decree was filed July 2003. We stipulated to the custody (joint legal, he has primary physical). The order states that I have the children every weekend and every other week in the summertime. We stipulated to this due to me living an hour away and we did not want to upset the children any more by changing schools. I am now living within one mile of them. Does this constitute a ''change in circumstances'' to be able to petition the court to change custody to joint physical custody (50-50)?

Possibly, you would have to petition the court to see - there are undoubtedly other factors which you have not mentioned which could make a difference.
