Name Change

My exwife remarried and took her new husbands last name. I also remarried and my new wife bears my last name. My exwife has divorced her most recent husband and wants to take my last name again. We do have children together, but I (and my wife) are opposed to her taking my last name again. Can she do this?

It is up to the judge. You can challenge her request if she is attempting to avoid creditors, commit some sort of fraud or for any other improper purpose. However, if she tells the court that she is taking back the name so hers is the same as the children and there are no other reasons, she will probably prevail.
