Name change concerning a minor

My parents have permanant guardianship of my sister's son. He has lived with us since he was 2 years old, he is 10 years old now. My sister's last name is different than our last name. He wants to change his last name so it's the same as ours. My sister agrees with the change, my question is, how do we go about getting his name changed?

Re: Name change concerning a minor

The legal guardians of the child can file a petition with the district court requesting that the name be changed. The child's mother would need to be given notice of the hearing. It would go much smoother if she consents. Even if she does not consent the court can make the change if the court deems that the change would be in the best interests of the child.
