How can I change my sons last name?

My sons father, or any other mamber of his family, has not been in his life since shortly after birth physically or financially. He is 8 now and still has fathers last name. Both my son and I would like his last name to be the same as mine. Can I legally do this? If so what would be my first step and is it a long expensive process? If the father agrees

You can file a petition in the district court where you live to change your son's name. It is a fairly simple process. You will have to notify the father, or get permission from the court to publish notice of the name change. If the father disagrees, amend your petition to terminate his rights for abandonment.
