Legal Question in Family Law in Utah

child custody

My ex lives in AZ and I live in Ut. He is in an out of my childs life, he hasn't seen the child in almost a year. I have sole custody. He is planning on coming into town and wants to see the child, he is also about $8,000 behind on child support. Do I have to let him visit with the child?

Re: child custody

Yes, you do have to let him exercise his parent time rights. The law expressly prohibits conditioning visitation on the payment of child support. If you withhold the visit, you could be held in contempt.

Re: child custody

If there is an order of visitation then he can seen the child. You can also file for an order declaring him to have abandoned the child. You may call for a free consultation.
