Child Support Arrears- When to draw the line?
I have a 5 year old son whose father is ordered to pay child support, half of insurance & daycare. I do have an open case with Utah's Office of Recovery Services who will garnish the father's income. The problem is, he currently resides in Colorado & changes jobs so quickly that the ORS cannot keep up with him. He is nearly ten thousand dollars past due. He has seen our son maybe 4 times in 5 years. We were never married. My son now sees my husband as his father. He wants to adopt my son, but is being deployed to Iraq next month & will be gone for approx 15 months. I'd like to have more control over what I am owed before he returns & we proceed w/ the adoption. I've spoken with my case worker & have been told that all they can do is keep looking for an employer. How much does he have to owe to be punished by law?? And what can I do to better my chances of getting what he owes? I probably have a better chance of winning the lottery, but I have to do something!

In a practical sense there is little you can do. You can contact your local prosecutor and see if they will prosecute your ex for non-support, but they rarely do that. Your current husband can adopt your son, as you can claim abandonment.
