Child Support and Restiution or Possible Law Suit for Assault
I have a few questions. First, if my divorce was in the state of Utah and my ex is in Utah and my son is with me, do we have to have a Utah attorney to get child support for my son?
The second is can my son file civil suite for assualt charges against his father from CA. or does he have to do get an attorny in UT? His father is being charged for several assualt and other charges for attacking my son and his boss (a woman) at his employment a few weeks ago. He is wliving with me and would like to sue his father what are our options in this matter. Would we be better off trying to get restitution through the criminal courts or filing a civil suite.
If possible I would like a CA. attorney for my son and myself since I have seen how attorney's in UT operate, not only now with my son's welfare but in the past on my behalf when I went through my divorce.

Under the Uniform Child Jurisdiction and Custody Act, which exists in Ca and Ut, you can file suit for child support and custody issues in the state where the child has lived for the past 6 mos. However, it may be more expeditious to file in the state where the father is, as garnishment of wages would be fast for a judgment in that state. Apparently you have not had a good experience with Utah attorneys, but they are not all the same. As in any state there are good and bad ones.
Your son will have to hire an attorney in Utah if the assault occurred in Utah. He may want to pursue criminal charges.
