Legal Question in Family Law in Utah

child support when not in school

My husband pays support for a daughter who will turn 18 in December. The support does not go through ORS. She dropped out of high school in sophmore year. His ex claims she will return to school and graduate this summer and is requesting that support be maintained until she graduates. What advice would you give in this situation?

Re: child support when not in school

My recommendation is that if the girl registers for school with a full schedule that support be paid as long as she is getting passing grades. The girl apparently has some problems, and if you need to use child support as a motivation for mother to keep her in school then it may help the girl get back on track. However, you need to monitor her performance to make sure the girl is doing her part.
