Legal Question in Family Law in Utah
Child right
I have a 6 year old daughter. Her father lives more than 150 miles from us well out of state. We don't have a court document stating visitation on long distance vistation. MY X husband and I came up with a verbal agreement on the vistation. We agreed on a date to meet and another for when she comes home. And now he says he is leaving it up to her when she wants to come home. She has a prior arrangment to be kept and I feel they are bribing her into wanting to stay longer. What are my rights and primary custodian in enforcing the vistation schedule.

There is an alternate visitation schedule in the Utah Code when the parties are out of state. Your ex is wrong in letting the daughter decide. He has a legal duty to require her to come on visitation. You can take him back to court for custodial interference. The Code does not say that visitation is up to the children, but is the DUTY of the parents.
