Child's right to choose

At what age does a child have the right to choose which parent she lives with? My mom is going through a brutal custody battle with my ex-stepfather, and although they have joint custody, he has primary physical custody. My younger sister wishes to reside in California with her mother, but her father will not sign the paperwork until he receives ''ample compensation''. My sister currently lives in an abusive environment, in Utah, with her father. She is 14 years old. Her father is threatening to put her into foster care.

The court will consider the wishes of a child in forming a custody order. The older the child is, the

more weight that the child�s wishes are given by the court. Someone should talk to an attorney immediately on this. Good Luck, Pat McCrary

In Utah there are at least 8 factors which determine when a child is placed with a parent, the opinion of the child is one of those factors. It sounds like father is a bully and control freak. Hopefully your mother has a good attorney.
