who claims the child if parents were never married and there is no court custody agreement, and no child support has been paid by the father, when child and mother live with mothers parents

If there is no court order nor other agreement, the parent that files first gets the credit. The mother should get an order of custody including the right for the child credit deduction and also file with ORS for child support.
