Legal Question in Family Law in Utah
Collecting Backed Up Daycare from Non-Custodial Parent
I divorced 6 years ago, and have a daughter from the marriage. My ex-husband was ordered to pay child support, health insurance, and 1/2 of the daycare bills. He has paid some child support, but none of the daycare or health insurance. I sent him bills occasionally, but never received money or response from him, so I stopped sending him the bills. I now want to try and collect money from the past 6 years, but he is refusing to pay because I did not send him the statements. Although I did not send the information to him, I did keep all of the bank statements and daycare hours. I also have all of the amounts that have been paid for health insurance - as well as documentation to back it up. Am I allowed to try and collect this from him, even though I did not send him the bills regularly in the past?

Re: Collecting Backed Up Daycare from Non-Custodial Parent
You can collect from him. Assemble all of your bills and create a ledger showing the amounts paid and the amounts owing, together will documentation. If he refusts to pay the bill you will have to sue him. You should also demand that payments be sent through payroll deduction direct to you. You may be entitled to up to 50% of his paycheck for past due amounts.
