Legal Question in Family Law in Utah
credit card debt after divorce
I divorced in Utah. We had a joint credit card with a balance, which I agreed to pay because I didn't believe he would do it. About a year and a half later, my ex-husband called the credit card company, and requested they send him a new card, claiming his was lost. He changed the billing address on the account so I would not recieve the statements. He transferred several thousand dollars from his delinquent accounts onto this card. I found out within a week, and he said he would make the payments on the card. I told him he needed to pay it off in full or somehow get my name off of the card so my credit would not be affected. He has ceased to make payments on the card, which leaves me responsible for them. I would like to know what I can do to get him to pay, or how I can file a judgment against him if I need to pay the balance to avoid detrimental marks to my credit. Thank you very much!!

Re: credit card debt after divorce
He has committed criminal fraud and can be prosecuted by your local district or city attorney. You can also notify the credit card company and explain to them what happened. He was not authorized and his fraud is not your fault. They should remove his charges from your account and reverse any negative reports. Your ex should be prosecuted. He will learn to be responsible that way. If you feel sorry for him and/or allow him to get away with such actions, he will not learn to be responsible.
