Legal Question in Family Law in Utah

Custody Battle-13 yo have to testify?

Temp order-50/50 (8 months ago) visitation supported by therapist. Spouse has made false child abuse allegations that were dismissed nearly immediately. (have never even spanked this child) Has turned daughter (13) against her therapist since the therapist wrote a letter to the court supporting 50/50. Ex wants sole legal/joint. Very agressive. Turning daughter against me-has her believing untrue things. He won't support therapy for her-just turns her against them. She says things that are untrue. We were always sooo close and now he has total control over her thinking. My therapist suggests he has borderline personality but he refuses therapy. How can I fight someone who lies and makes up things? He is very persuasive. He even has my daughter agreeing with things he accuses me of. If she has to testify, she will say whatever he wants her to. I have been in therapy since day one of divorce filing to cope with his behavior. I feel no hope for my daughter-may be easier to give him sole?? If she and I have even a little disagreement she calls him, he tries to talk her into calling 911 for family dispute (he is a cop) HELP-she is a danger to me now with lies. He using her against me. Wil lshe have to tesitfy? He wants her to

You will need to be as strong as your ex. He knows you "buttons" and pushes those to manipulate you. He is doing the same with the daughter. I suggest that you fight for sole legal custody on the grounds that you cannot communicate. Daughter will not testify.
