Legal Question in Family Law in Utah

custody

My duaghter has a 5 yr old boy out of wedlock. She is the care giver and support of him.The father sees him whenever he would like to.She let the father have him for christmas and he refuses to give him back until a legal court visitation is drawn up.What are her rights and how can she get him back ASAP.

Re: custody

If there is no court order granting the father legal custody or visitation, then he has no legal rights to the child under Utah law. Have her call the police.
