custody

my husband has been in and out of the kids life since birth he does not pay child support and has a criminal record he never has a stable home he lives with either family or withhis girlfriend in another state can he get custody?

Probably not based on what you said. However, a court will look at what is in the children's best interests. Sounds like he is good at threats.
