Legal Question in Family Law in Utah
I've been dating a woman for sometime now and we are talking about marriage. She divorced her ex husband in the USA, Utah and I just found out shes not divorced from her husband in her own country. They have a divorce decree in Utah only when he was here in Utah, Is Utah decree good enough?
They married in Brazil 17 - 18 yrs ago in Brazil, he now lives in Brazil she lives in Utah, she is not a US citizen.
She had a Utah divorce, but the fact remains, Is she still married in Brazil. Her Ex husband, if you call him an EX, wants to re-marry in Brazil and needs my girl friend to sign doc's to allow him to do so.
I want to know if my Church ( Mormon ) follows the law of the land that governs the marriage, because we want a church ( temple ) marriage.
I'm not sure if the divorce in Utah is legally binding in Brazil
Is this going to be bigamy? Am I actually dating a married woman?
I'm guessing, since she is a citizen of Brazil and got married in Brazil, my Church recognizes the marriage laws in Brazil, not the US.
We want to marry, but this is hanging over our heads, Am I dating a married woman?
Thanks
Scott

The divorce decree in Utah is good for all states and countries. You can legally marry. The LDS church will recognize the divorce in Utah as a valid divorce.
