Legal Question in Family Law in Utah
my daughter is 26 years old and has a 3 1/2 year old son. They both live with us and we are totally supporting them. She is looking for work. We pay for everything. She refuses to go after hte childs father (which she was not married to they just lived together for 3 years) he gives her absolutley no money at all. Not even for his childs needs. I think there may be something I may not be aware of from a previous criminal charge ( she has a misdemeanor and is surrently on probation. But he has her convinced because of this , she better not go after him for support. Do I as my daughter and grandsons sole support have any rights to act in her behalf and file the papers for her?

I would recommend that you file for guardianship of your grandson. Once you are appointed legal guardian, you would have the right to pursue collection of child support from the father. Until then, you wouldn't have any standing to do anything about it. From what you describe, your daughter shouldn't have anything to fear. If you would like, I could meet with the two of you for a free consultation.
