Legal Question in Family Law in Utah
My daughter's custody agreement gives him the right to request a urine test. All tests have come out negative but there is a possiblity this one will not. What are the consequences if she refuses to do so. Her whole case has been unsubstaniated against her. She has a 4 year old daughter and had a false protective order against her back in Jan of 2009. He has a good lawyer and hers sucked and he didn't question anything in the written agreement and advised her to sign it. She still has not seen judge over this whole thing. She could lose her unsupervised visits if she doesn't pass this test.

Usually a refusal to submit to a court ordered drug test has the same consequences as testing positive, so she might as well submit to the testing. Since I'm not familiar with all of the particularities of the case, it's difficult for me to give any further opinion. I offer a free initial consultation in the event she wants to discuss this matter further.
