Legal Question in Family Law in Utah

Desperate aunt, needs custody.

My sister,18 and boyfriend,17 have a baby and now broke up due to domestic violence of both parties. Police got involved and Im afraid CPS will be too. Can I get custody as the aunt? The father 17 years old left to CA but threatened to come back to ''take'' the baby. I'm married w/ 4 childrn, own a home in Utah. the parents are both unstable financially and emotionally. Can I prevent the baby from getting taken away by CPS? Should I file for custody or adoption? Can father actually take him?

Father may have rights, but are limited unless he filed for paternity at the time of the birth. IF CPS takes the child, you should have an opportunity to file to be the temporary guardian. If your sister will cooperate you can get temporary custody through the courts.
