divorce amendment

My x-wife and I signed an agreement regarding my retirement funds after the divorce was final. We both signed the amendment and had it notarized. Is this a valid legal agreement, or is something that has to be taken back to the court?

You need to get a Qualified Domestic Relations Order, signed by the judge and submitted to the retirement fund. I can assist if you like.

As long as both of you signed the agreement, it is legally binding. However, you should also have the judge sign an order which formally modifies the provisions of the decree of divorce. From there, the court will need to sign a Qualified Domestic Relations Order which is submitted to the retirement account administrator to carry out the agreed upon division of your retirment account.
