Legal Question in Family Law in Utah
divorce
My divorce decree is set up to where i have my kids tues thurs and sat. Then it has areas for holiday and extended parent time. My ex said she asked an atty and they told her that since the divorce decree was ammended for my parent time that eliminates my extended and holiday parent time. It says nothing in the decree about ammending holidays or parent time . is she just lying to me so i cant spend those times with my kids????

Re: divorce
If your decree has provisions for holidays and extended parent time, then that is when you have that parent time. Normally, if your decree modifies the statutory parent time, then what is contained in the decree controls. You ordinarily wouldn't get holiday and extended parent time outlined in the decree PLUS holiday and extended parent time provided for under the statutes. Without seeing your decree itself, it's a little difficult for me to answer your question.
