Legal Question in Family Law in Utah
my divorce decree states that i get my kids tues, thurs, and sat. because I worked weekends so me and my ex agreed upon that.now we are in the process of modifying our divorce decree. I want everyother weekend now im not working weekends anymore. My ex says I cant have them sundays because they need to go to church with her. and if I want to have them sundays I have to take them to church or else I cant have them. If I dont agree and we go to court do I have a chance of the judge giving me my kids everyother weekend without her making me take them to church? My next question is the divorce decree states that she gets to live in the house we bought while married but is only in MY name not hers as long as she makes the payments. She has always been late 2-3 months on the house payment and my credit is so bad now. She has remmaried and her and him live in the house still. I want to have the judge make her within 2 years put the house in her and her husbands name so I can rebuild my credit What are my chances of that going in my favor also?? Please help me !

You have the right to change visitation to weekends. You will need to go to court to get a new visitation schedule, which the court will probably base on the alternate weekends schedule. The court can and will address the child's church attendance, but your time with your child is more important to the courts than who takes her to church. You can also sue her for the damage to your credit and force the sale or refinance of the house. You may call for a free consultation.
