Legal Question in Family Law in Utah

My divorce decree

My decree says that my wife is to use child support money for the house payments. The house is always two -three months late. If the house is only in my name and she is the one living in it with our kids and her NEW HUSBAND. I plan on asking the judge to make her put it in her name within 6 months or let me sell it so she can stop ruining my credit. Will the judge allow that?

Re: My divorce decree

The judge can hold her in contempt for failing to pay the mortgage. You can ask for possession of the home or other sanctions. Child support cannot be exclusively dedicated to house payments, it is to be used for the best interests of the child at the discretion of the custodial parent.
