Legal Question in Family Law in Utah

Divorce- financial responsibiity to common assets

Although I am not legally married I am considered common law married and am going through a divorce. In the separation my spouse kept the house and is planning on refinancing it in his name; however, he cannot for a few months. Is there anything I can do to waive financial responsibility until the house is refinanced in his name? I am afraid that my credit is going to be ruined in this whole process.

If your name is on the mortgage your are equally responsible to make sure the mortgage is paid as your husband. If your name is not on the mortgage and he does not pay it, you will not be harmed.
