I have been married for 16 years and we are getting divorced. I have not lived in my home for over 1 1/2 years. I want my share of equity in the home. I feel my attorney has not represented me well. My attorney has told me that the judge will not give me my share of the equity ever rather now or later because my estranged wife has Multiple Sclerosis and is confined to a wheel chair. Also, I have two sons that live with her but I would like joint custody. I need my equity so that I can purchase a home of my own so that my sons have somewhere to come. I have been paying child support and temporary alimony for over 1 1/2 years which leaves me no money to live on my own. Do I have a right to my equity now or after my sons turn 18? Should I obtain a more agressive attorney? Also, because of the aggressiveness of her Multiple Sclerosis it is not likely she will live another 5 to 10 years and then what happens to the house. Please advise me as I feel like I am at a loss and don't know what rights I have or what to do next. Thank you
