Legal Question in Family Law in Utah

Divorce after 30 year separation

My fiance (whom I live with) just found out that he is NOT divorced, after thinking he was for 30 years. He was told that his wife divorced him while he was serving in Vietnam. Now, after trying to verify the divorce, he found out she never divorced him. What is the fastest, cheapest way to get this divorce? They were married in Texas where she still lives. He lives in Utah. Should we be concerned with community property issues?

Re: Divorce after 30 year separation

The quickest and fastest would be for both of them to agree that there are no property issues and for both to stipulate to an immediate divorce. I do not know the law in Texas but you can get a stipulated divorce in Utah in a relatively short time if both parties agree - about 1 month to six weeks.

Since they have both been living apart for so many years there should not be any community property issues - unless one of them wants to make this a fight.
