The statute provides that if the party requesting reimbursement doesn't comply with the provisions of that statute, the court "may" deny them the right to reimbursement. In other words, if the parties go to court over this issue, it's up to the judge's discretion whether to enforce the reimbursement. It depends, in many respects, on the circumstances of the case.
