Legal Question in Family Law in Utah

Emancipation in a Joint custody situation

We have a 17 year old who desires to

be emancipated because he does not

wish to live with us. His father does

not want him to move back with

him,but won't agree to emancipation.

It is a joint custody situation. Can he

still be emancipated with only one set

agreeing?

Re: Emancipation in a Joint custody situation

The test for emancipation is not whether the parents agree, but whether the 17 year can actually care for himself without his parents. This means he needs a job with sufficient income and a place to live.

This boy needs counseling so he will finish school and get a job.
