Legal Question in Family Law in Utah

How to enforce a visitation order; custodial parent not compling

My ex-husband has sole custody of my kids. I have not been proven unfit or anything like that. There was a very hostile relationship. He had more money than I did and he was granted custody. I have been told that I would need upwards of $3000.00 to file for joint custody. There is a visitation order that he has not followed for the past 4 months. We have been before a judge on this problem before. The judge stated that if he kept the kids form me again, he would go to jail for 30 days to start. I don't really want to pick up the kids with the police. I would like to have him stand before the court with an Order to Show Cause hearing. Can I do this without an attorney effectivley? My ex-husband is a convicted felon. Since his mother has passed away, he will no longer be able to finance an attorney. He has asked me to come to his work so he can ''kick my ass.'' He has abused the kids and it is doucmented with the state. They will not take them away from him even though there is physical evidence of this violence. Thank you in advance.

You may want to contact Utah Legal Services, which provides low or no cost legal services. Based on the facts which you related, it appears that you have a good case to get custody of your children. The cost through an attorney could easily be $3000 - but investigate Utah Legal Services. You may want to also contact the Division of Child and Family Services.
