Legal Question in Family Law in Utah

enforcing a divorce decree

20 years ago I was divorced. The divorce decree was drawn up by my husband who stated that upon sale of our jointly owned condo that I would receive 1/2 the equity. Neither of us have lived in the unit untill recently. The condo was rented out and the rent monies paid on the mortgage. I have just learned that the condo has now been paid in full, my ex has rrretired and moved into the condo. Is it possible for me to now require him to buy off my interest in the equity?

Re: enforcing a divorce decree

You can get a court order either requiring him to pay you 1/2 the fair market value in rent or forcing the sale and dividing the equity (or your ex paying you 1/2 of its value.
