Legal Question in Family Law in Utah

my exhusband is in prison for violationg porole he has a 8 month old baby, in which the mother has lost her rights to. My ex's mother has taken the baby and wanted to keep her temporarly until her son was able to take over. The baby is well provided for, yet the judge just told her that she had to give the baby to the courts so that they can put her in foster care instead! What can she do in able to keep the child?

I'm a little surprised that the court isn't looking to her first to place the child since kinship placement is usually preferable to foster care. She should retain an attorney and file a petition in the case to be awarded custody of the child.
