Without knowing when your divorce was granted and what your divorce decree provides, it's difficult for me to answer your question. Under the current statute, the parents divide the Christmas break evenly with the exhange occurring at the halfway point of the break. Generally, this would result in the parent having the second half of the break not having the child or children at all on Christmas Day. The break you're describing is the shortest I've heard of yet this year. Many schools begin their Christmas break on Friday December 19th and resume classes on Monday, January 5th. If your daughter is literally going to school on Christmas Eve and returning to school on January 2nd, then her break is only 7 days long which would result in your exchange occurring on December 28th at 1:00 p.m. I would recommend that you double check your daughter's schedule as I'm unaware of any school district in the state that is convening classes on December 24th.
