extended summer visitation time with a non-custodial parent's family

A non-custodial parent wants to send my daughter off with his family to another state for his extended summer visitation time. He is not going with them. Is that legal, because technically, he is not exercising the visitation time if the child is out-of-state.

It is my opinion that the rights of the actual parents exceed those of a third party. Unless the divorce decree addresses the issue, you should be able to contest the trip. The court will look at the trip and decide whether it is in the best interests of the children, including any risks to the children, and any deprivation of your parental rights.
