Falsley accused dad served with an EX PARTE PROTECTIVE ORDER

on April 24th I was served with an EX PARTE PROTECTIVE ORDER while I was watching my two sons. The Officer told me that he had never seen this document served on anyone under the conditions. Her charges are false. In seven years or marriage I have never touched her or the children. There have been no allegations, no police reports, no injuries to anyone. Her complaint is deep down that she wants us to do better financially. I am a good parent and since she started a job two months ago I have been the primary care giver , at leeast in parity with her. She has been being treated for depression for about two years. I cannot talk to her, see my kids, talk to her parents, her brother etc. until the hearing in three weeks. An indication to me by a common friend indicated that she had been told that if she filed this she would be more likely to get custody of the children if she decided to divorce me. I have never been able to get her to counseling to talk about any of her concerns. I love her and the kids and am dying inside. Question 1: Can I do anything about this before the hearing in three weeks? Question 2: Do I need to get a lawyer? (I do not have a lot of money)

You should appear at the hearing with witnesses and whatever evidence you can and refute the charges. Talk to friends and relatives to see if any of them have information as to why she served you with the Order. This situation is highly fact specific and depends on the nature of the requested order. Go to http://www.fatherhoodcoalition.org and call their HOTLINE number.

They have volunteers to explain all of this to you.

Almost all the guys have been served with these

protective orders. They are called 209As in

Massachusetts.

Such an order is, indeed, a tool or weapon in a divorce where there will be a custody fight.
