Felony and Divorce

I am writing on behalf of my sister, a Utah county resident.

She has been married for about 7 years. She recently (Saturday)

found out that 5 years ago her husband stole $40,000 from the

company he previously worked for.

They have tracked the theft to him and he will be pleading his case

out soon.

My question is: is she (her portion of joint assets) liable to pay off

his debt if she files for divorce?

Probably not unless she knew or should have known of his fraud. If she knew or if she benefitted from his fraud then she might have some liability. It will depend on the facts which can be proven. She needs an attorney to counsel her.
