Legal Question in Family Law in Utah

My fiance died this past Friday. We had plans to marry soon. Those were his last wishes and he wanted my name to change to his last name. I have texts, sticky notes of his love for me and we both bought each other wedding rings. Someone told me I could marry him still. It seems weird but those were his last wishes. His death was unexpected.

I'm sorry to hear about your loss. Unfortunately, you cannot posthumously marry someone. A marriage license would need to be issued to a living person and only a living person could give his consent to be married. You can, however, change your name to whatever you wish, including his last name. It involves filing a name change petition with the court.
