Legal Question in Family Law in Utah

Who should file?

Does it really matters which spouse files? The only problem I see would be that she will fight me about material items such as furniture, cars and a Time Share we purchased together.

It does not matter who files first. If you are dividing significant assets or if the divorce involves children it is wise to have legal counsel.
