Legal Question in Family Law in Utah
Full Custody and out of state visits
I have full legal and physical custody of my 1 year old and 3 1/2 year old. My exhusband lives in Indiana and I live in Utah. He comes to Utah 2 times a month on business to see the boys. He only has visitation rights. He is planning to get married to a woman in Indiana and I think they will be residing fulltime there. Will I have to send my boys there (Indiana) for visits in the summertime? It is very far away and they are very small still - and his lifestyle is a complete mess - drinking - partying - living with his girlfriend. What am I up against here? Also, I fear that he will want the boys at his wedding....she is the one he cheated on me with ..... is any judge going to make me send them to Indiana for that? Thanks?

Re: Full Custody and out of state visits
He will have visitation pursuant to UCA 30-3-35.5. You can refuse, which will probably lead to a court hearing where you can argue why you do not want the children to go to Ill.
