Legal Question in Family Law in Utah
Hello and good morning,
My question is- My husband has a business with a partner for over the last 10+ years. Originally when the company was started we all (husbands and wifes) went into the bank and sign loan papers to start the company. The men run the company and agreed between them (the Husbands) that the wives would not be involved. I would like to know if I have any right of going into the office and going through some of the books? Or if I would get in trouble doing so. My husband is the COO of the company, and tells me I have no business or right at all in being able to look at any of the companys taxes, contracts, etc.That it is his company and I have no rights to it at all. Is this true as I signed my house and everything we owned as collateral to start the business. We have been married 21 years now and he has been to see an attorney about getting a divorce. What are my rights where the business is concerned? Thank you for taking the time to read and answer in regards to my concerns.

If you are an officer of the company or member of the LLC you have a right to look at the books. Otherwise as a part of your divorce the books could probably be produced.
You have a right to at least 50% of his interest in the business.
