Guardianship of ex-stepson

I have a stepson from a previous marriage who needs medical assistance. Neither of his biological parents are able to provide health insurance, but my health insurance policy will add him until he is 26 if I can demonstrate ''legal guardianship.'' My stepson is 21 years old. What do we need to do to create a legal guardianship?

File a petition with the court to get legal guardianship. His legal parents will have to cooperate.
