Legal Question in Family Law in Utah
Ex Husband Controlling Alimony Spending
December 2002 I recieved a check in the amount of $1943.00 which was a refund for bail money that my ex-husband had paid to get our son out of jail. The check was in my name however I was supposed to return the money to my ex-husband, but instead used the money to go to California to see my new born Grandson. I have recieved alimony in the amount of $950 each month for the last twenty years. I agreed to pay back the $1943.00 having my ex-husband keep the $950.00 for each month until the $1943.00 was paid in full, however now that the $1943.00 is completely paid off instead of paying me my $950.00 in alimony he has decided not to pay the alimony to me until a car loan that I have with him is paid off (approx $6,000 left). I have been paying him $200 a month for the car, but since this incident he is mad and is now keeping ALL the money until the loan is paid in full. My question is can he do this with my alimony without my permission? Does he control how my alimony is to be spent?
Thank you for your help!

Re: Ex Husband Controlling Alimony Spending
Your husband cannot control how you spend your alimony. If he cannot show proof of payment for alimony you can garnish his wages or other assets. Tell him to ease up or you will return to court for an adjustment in alimony for cost of living increases as well as for the back unpaid alimony.
