My husband and I both are resident of salt lake valley from last 3 years.

We both want to file divorce now mutually agreed.

Do we have to live apart legally before we file divorce in salt lake county?

What is the waiting period that we need to wait?

There is no requirement that parties be separated before they file for divorce. As long as you've been a resident of Salt Lake County for more than three months prior to the filing, you may do so in the Third District Court in Salt Lake County. If there are children involved, there is no waiting period before the divorce can be finalized. If there are no children, then there is usually a 90 day waiting period before completing the divorce. However, the court will usually waive the 90 day waiting period if you file a motion requesting such a waiver.
