Legal Question in Family Law in Utah

Legal Gaurdianship

My husband and I just received legal gaurdianship over a 16 year old. Now she wants to move back with her real parents. What do they need to do to get legal responsibility back. We want to make sre that we will not be responsible for anything for her is she moves back with her real parents.

She wants to move back as soon as possible.

Any help wpuld be appreciated.

Thank you

Re: Legal Gaurdianship

You obtained legal guardianship under a court order. Reasons were given to the court which made the judge believe it was in the best interests of the child to have you appointed guardians. Have those issues been resolved? If so, the parents can seek return of their legal status. As legal guardians you have a duty to make sure that the child will be safe, and that the return is in her best interests - which is not the same as being her desire. So, no matter what her desires are, you have a legal responsibility to make sure the descision is reasonably in her best interests.
