legal rights to (dead) sisters kids

can i take her two kids for overnights until i get custodity of them, my mom has them living with her right now and will not let me take them, she wants to get legal rights them, i have contacted the kids dad and he said he doesnt want them i can have them.

A hearing in front of a judge is necessary to determine who will get custody of the children. You can apply for custody as well as the grandmother.
