not married, judge gave temp custody to ex girlfriens parents

some 1 calls dcfs and girl friend (has 2 kids) tests positive for meth and coke dcfs calls her and her parents into court dad (1 childs his) finds out goes to court judge signs temp custody to her parents with out letting dad have baby when dad asked judge why he coulnt have baby judge say you will need to fight for custody does he not have 50% cousty of baby and if she cant take care of baby why does coustdy automaticly go to other biological parent. i (aunt) used to have baby 3 days a week and dad every other weekend now even though judge didnt give dcfs any custody we have to go through them in order to see baby and we only get 1 hr a week supervised (by a social worker) visits at our local dcfs building. whats in the best intrests of the child was not a heart on this dision because not only is baby being keept form dad but also myself my husband and my 2 kids are heart boken because he doesnt get to stay with us no more. please tell me where to go next or whats going to be next we miss baby so much and grand parents that have him now will not answer any of my calls and they dispise babys dad.

Baby's father needs to file petition to determine custody; you need to file papers to be considered candidates to be caretakers for child. DCFS makes recommendations which the judge often follows, and apparently recommended the current custodial family. You will have to fight for the right to be involved with the child. You will need an attorney.
